Poppy’s Flower Design – Terms & Conditions

1.    Products
1.1    All products displayed on this website are subject to availability and may vary from time to time. Products are available for collection from our shop in Leyland, UK. Delivery is Post Code based and the delivery zones can be found on the Delivery section of the website.
1.2    Certain products may be delivered in bud to ensure maximum freshness and longer vase life.
1.3    Some flowers and plants may be harmful or poisonous if ingested. If you require further information before placing an order, please contact us by telephone or email.
1.4    Due to seasonal availability, we reserve the right to make reasonable substitutions of flowers or containers of equal or greater value and quality where necessary.
1.5    If we are unable to supply your chosen product or a suitable substitute, we will notify you as soon as reasonably possible and provide a full refund, no later than 30 days after the intended delivery date.

2.    Prices
2.1    Prices shown on the website are valid at the time of purchase.
2.2    All prices are inclusive of VAT, where applicable.

3.    Orders & Payments
3.1    When placing an order, you must provide accurate personal details, including the full delivery address, postcode, and contact information for both the purchaser and the recipient.
3.2    Payment may be made using most major credit and debit cards.
3.3    By placing an order, you confirm that you have read and agree to be bound by these Terms & Conditions.
3.4    Submission of an order is subject to our acceptance. You will receive an email confirmation once your order has been accepted.

4.    Delivery
4.1    Delivery is available only within our designated local delivery areas.
4.2    We do not deliver on Sundays or UK public holidays except for Valentine’s Day and Mother’s Day.
4.3    While we make every reasonable effort to deliver on the requested date, delivery dates and times cannot be guaranteed.
4.4    In rare circumstances where delivery is not possible, we will contact you where possible and either:
•    arrange an alternative delivery date, or
•    provide a partial refund.
4.5    Deliveries to locations such as offices, hotels, or other business premises may be accepted by any authorised person on behalf of the recipient.
4.6    Once an order has been delivered correctly to the address provided (or to a neighbour where appropriate), we cannot accept responsibility if the recipient has moved or refuses the delivery.
4.7    Where delivery cannot be completed, the driver may leave a calling card or deliver to a neighbouring address where appropriate.
4.8    Requests for preferred delivery times should only be used for funeral orders. While we will try to meet these requests, delivery by a specific time cannot be guaranteed.
4.9    Delivery instructions provided in the “Notes to Florist” field are advisory only and may not always be possible to follow.

5.    Cancellations & Amendments
5.1    Nature of products
All flowers sold by Poppy’s Flower Design are fresh, perishable, and made to order.
5.2    Early cancellation period
Orders may be cancelled or amended up to two working days before the scheduled delivery or collection date.
A £2 administration fee applies to cover payment processing and administration costs.
5.3    Definition of working days
Working days are Monday to Saturday, excluding UK bank holidays.
(For example: Monday delivery → cancel by Thursday.)
5.4    Cancellations within two working days
If an order is cancelled within two working days of delivery or collection, a 10% cancellation fee will apply to cover costs already incurred, including the ordering of flowers from our suppliers.
A £2 administration fee also applies to cover payment processing and administration costs.
5.5    Refund options
For cancellations within two working days, customers may choose either:
•    a full credit for the value of the order to be used at a later date, or
•    a refund minus the 10% cancellation fee.
5.6    How to cancel
To cancel or amend an order, please contact us as soon as possible using the contact details on our website. For same-day orders, customers must contact the shop immediately.
5.7    Fraudulent payments
Nothing in these terms affects your statutory rights. If your card has been used fraudulently, you are entitled to cancel the payment and receive a refund in line with your card provider’s policies.

6.2    Due to the perishable nature of flowers, any issues must be reported within one working day of delivery so we can investigate promptly.

7.    Liability & Disclaimer
7.1    We do not exclude liability for death or personal injury caused by our negligence.
7.2    Subject to clause 7.1, our total liability for any claim shall not exceed three times the value of the order.
7.3    We shall not be liable for indirect or consequential losses, including loss of profits or business, except where prohibited by law.
7.4    Nothing in these Terms & Conditions affects your statutory rights under the Consumer Rights Act 2015.
7.5    We shall not be liable for failure or delay caused by events beyond our reasonable control.

8.    General
8.1    We may update these Terms & Conditions from time to time to reflect changes in the law, our business practices, or how we operate. The latest version will always be available on our website.
8.2    It is your responsibility to review the Terms & Conditions before placing an order. By continuing to use our website or placing an order, you confirm that you have read and agree to the current version of the Terms & Conditions.
8.3    If any part of these Terms & Conditions is found to be invalid, the remaining provisions shall remain in force.
8.4    We comply with all applicable UK data protection laws. Personal data is handled in accordance with our Privacy Policy.
8.5    These Terms & Conditions are governed by English law, and any disputes shall be subject to the exclusive jurisdiction of the English courts.
